The PKPA was intended to preempt state laws, the intended federal preemption makes a claim of its violation a federal question. The basis for federal preemption comes from the Supremacy Clause of the Constitution, the second clause of Article VI. `The Violence Against Woman Act, 18 U.S.C. §2266, referred to the PKPA with rights creating language in the VAWA definition of “protection order.” 18 U.S.C. §2266, Editorial Notes, Amendment 2006—Par. (5). Pub. L. 109–162, § 106(d)(1). The language containing the definition of protection order, may still be found in the historical notes of the VAWA. This legislative language reveals that Congress intended the Parental Kidnapping Prevention Act (“PKPA”), 28 U.S.C. § 1738A to create an entitlement right. The VAWA creates the express preemption and makes the case for field preemption. “Cases such as Cort v. Ash, 422 U.S. 66, 95 S.Ct. 2080, 45 L.Ed.2d 26 (1975), hold open the possibility that clear legislative history with statutory language creating personal entitlements, may create a right of action even though the statute is silent.” Dillon v. Combs, 895 F.2d 1175, 1177 (7th Cir. 1990). By way of Wis. Stat. § 802.12 inclusion of binding arbitration the State’s regulation is in functional conflict with the PKPA, therefor the case for federal jurisdiction arises from conflict preemption
Plaintiff filed her claim for redress in the Western District Court of Wisconsin on March 20, 2023. The claim was timely because was filed within two years from the act of the State supreme appeals court clerk and was filed within three years from the State's violation of the PKPA, 28 U.S.C. §1738A. Wilson v. Garcia establishes a three-year statute of limitations for all 1983 claims. Id., 471 u.s. 261 (1938). Further more it was argued the violation is ongoing, and there is a likelihood of re-occurrence that necessitates the claim for injunctive relief.
